In today’s day and age, everyone should know that asbestos is a toxic mineral that causes a fatal cancer called mesothelioma as well as other asbestos-related diseases.  Even a single incident of exposure can put someone at risk of years later developing cancer, asbestosis or lung diseases, so all efforts should be made to prevent any contact with asbestos containing materials.

For the most part, new use and manufacture of asbestos products is prohibited by federal regulations.  Highest risk now occurs for workers who are working in environments where there is in-place asbestos already on site, such as construction workers, emergency relief workers, mechanics, and ship repairmen.

Chest Pain: A Common Symptom of Malignant Pleural Mesothelioma

Mesothelioma is an incurable form of advanced lung cancer caused by prior exposure to asbestos.  Malignant pleural mesothelioma begins when an asbestos fiber becomes inhaled and lodges in the pleura, or thin membrane sac surrounding the lung.  There is a long latency period, up to sixty years, between the time the asbestos enters the body and cancer develops.

Collecting From A Defunct Corporation for Asbestos Injury

Because it can take decades for asbestos-related diseases to manifest after exposure to asbestos or asbestos-containing products, pursuing an asbestos-related lawsuit requires knowledge of and experience with locating viable defendants. But even after determining who to sue and successfully obtaining a judgment or settlement against that defendant, one still must be able to collect against that defendant. While pursuing an asbestos-related lawsuit on behalf of one of our clients, we encountered this problem.

Our client worked as a plumber and pipe fitter from 1957 to the mid-1970s. Client installed plumbing and heating systems alongside insulation contractors who would install asbestos pipe covering and dry asbestos cement on pipes, boilers and fittings. Plaintiffs alleged that he was exposed to asbestos dust from the mixing of the dry cement with water and from the cutting of the asbestos pipe covering while working alongside insulators employed by a certain insulation contractor.

This insulation contractor did not answer or respond to the complaint. Although the insulation contractor had insurance during the time frame of Client’s exposure to asbestos, and the lawsuit was tendered to that insurance company’s successor insurance company, the successor insurance company did not respond to or defend the lawsuit.

We filed a request for default judgment against the insulation contractor and, after the Court held a hearing for Plaintiffs to prove the requested damages, we obtained a $2.67 million dollar judgment against the insulation contractor. The insulation contractor and Plaintiffs entered into an agreement where Plaintiffs agreed not to attempt to collect on the judgment against the insulation contractor in exchange for the insulation contractor assigning its claims it might have against the successor insurance company for failing to defend it in the lawsuit.

We then filed a lawsuit against the successor insurance company in San Francisco Superior Court for breach of insurance contract, breach of the duty to defend and duty to settle, and for bad faith, amongst other causes of action. The successor insurance company removed the lawsuit to federal court.

Although there was a one-page certificate of insurance listing a policy number, no other documentation concerning the insurance policy existed. The successor insurance company contended that there was no evidence that there was an insurance policy that covered the applicable time periods, and no evidence that the insurance policy listed on the certificate of insurance would have covered our client’s claimed exposure to asbestos and subsequent diagnosis of mesothelioma.

We spent hundreds of hours researching and searching for insurance information, as well as what the terms of the insurance policy likely would have been. Although information specific to this insurance policy was not located, we were able to piece together what the terms of the insurance policy likely were, and that the insurance policy likely covered Plaintiffs’ claims. To do this, we tracked down documents from the now defunct insurance company and documents concerning the types of standard insurance policies that were issued in the 1960’s.

We also were able to locate and speak with the individuals who sold the operative insurance policies decades ago, who recalled selling insurance policies to the insulation contractor. After collecting this evidence and successfully defending several motions that would have disposed of the claims against the successor insurance company, the successor insurance company agreed to settle the case for a substantial amount.

Dendritic Cell-based Immunotherapy for Mesothelioma Looks Promising

Results from recent studies verifying the safety of a novel DC based immunotherapy designed to be used as a vaccine against mesothelioma found it was safe enough to go on to the next phase of testing.  Indeed, tests show that the form of immunotherapy combats mesothelioma tumors directly.

The vaccine was created by scientists in the Netherlands and was designed in such a way that it uses the patient’s dendritic cells (cells within the immune system that pass antigen material along to other immune system components for isolation and removal) with antigen material from the patient’s existing tumors.  This creates an automatic immune response—the patient’s body begins to attack the tumors.

The results of the study were published in their approved state online and will be in a print edition of the American Journal of Respiratory and Critical Care Medicine.  Results show a positive T-cell reaction in 10 of the studies subjects.

This is the first time that dendritic cells have been exploited in a vaccine to fight mesothelioma.  “The possibility to harness the potency and specificity of the immune system underlies the growing interest in cancer immunotherapy,” said Dr. Joachim Aerts, a co-author of the journal article.

The advantage of this type of therapy over traditional mesothelioma treatments such as chemotherapy and surgery is that it is designed to specifically target the mesothelioma tumors and nothing else.  If proven effective in future testing, the vaccine could be used in the general population to help slow and possibly even reverse the process of tumor growth in mesothelioma patients.

Mesothelioma is caused when fibrous particles invade the soft tissue of the lung or digestive tract and cause tumors or fibrotic cysts to grow.  As of yet, there is no cure for mesothelioma and once diagnosed most patients the median survival rate is about 18 months.

If successful, this new immune system treatment could not only be used to treat mesothelioma patients but perhaps even be developed into a vaccine that would keep tumors from forming in people exposed to hazardous carcinogens.

Top Reasons for Advanced Directives when Diagnosed with Mesothelioma

When diagnosed with mesothelioma, there is often very little that can be done to treat the cancer, especially if it has reached advanced stages.  The reality of end of life is unavoidable as there is no cure for mesothelioma, although researchers continue to investigate new treatments in hopes of finding one.  One way for patients and family members to have some sense of control is by completing an Advance Directive.

We strongly urge our clients to complete an Advance Directive, which would include a living will and a durable power of attorney for health care.  An Advance Directive is a legally binding document that states what the patient’s wishes are when it comes to end of life care.

The Living Will is part of that, and states all preferences for care, especially if one were to become unconscious or able to communicate on his or her own behalf.   The medical power of attorney, also called a durable power of attorney for health care,  is a legal document which appoints someone to make medical decisions for the patient in the event he/she is unable to do so.

We advise our clients to have a do not resuscitate (DNR) order as part of their living will if this is one of their wishes.  A DNR is followed by all states and is an order directing the hospital staff or treating medical team to not use cardiopulmonary resuscitation (CPR) if you stop breathing or your heart stops beating.

Even though talking about end of life care can be difficult, many of our clients and their loved ones have been very grateful to have completed advance directives as it allowed them to have much more choice about treatment and interventions.

Asbestos Lawsuit Stay Granted In Vest v. Allied Packing & Supply

Westlaw recently reported that the Northern District of California stayed an asbestos lawsuit in which plaintiff was claiming his asbestos related illness was due to exposure to asbestos brought home on his father’s work clothes and from visiting his father while he worked on airplanes at the World Airways’ hangers in California.  (Timothy Vest, et al. v. Allied Packing and Supply, Inc., et al.)

Secondhand exposure to asbestos, such as in this case, is just as likely to cause asbestos related injuries, such as mesothelioma and lung cancer, to family members who come into direct contact with workers handling the toxic material.  Usually cases are filed in the state in which the exposure occurred, in this case, California.  California law helps people who have an asbestos related injury sue and receive fair compensation from responsible parties.

Defendant McDonnel Douglas Corp. requested the case be transferred from Alameda Superior Court where it was originally filed in December of 2009 to the asbestos Multidistrict Litigation in the Eastern District Court of Pennsylvania.  The Plaintiff’s immediately filed an Emergency Motion to Remand to the state court, but the Court refused to hear it unless the Multidistrict Litigation proceedings are “unreasonably protracted” or if the plaintiff’s medical condition were to become worse.

Asbestos companies and manufacturers will often try to find a reasonable cause for moving to a jurisdiction outside California, hoping that the other state’s laws are not as favorable to the plaintiff.   The court often has to determine if there is a more suitable alternative forum, and the end decision is always up to the judge’s discretion.

Sometimes the need for making the trial less financially burdensome and more expeditious (especially in the case of advanced illness) takes precedence and judges will not grant motions to move jurisdictions.

Discussing End of Life Care with Mesothelioma Patients

Being diagnosed with mesothelioma,  a terminal cancer,  is devasting and overwhelming.  It requires great courage and support to enter into end of life conversations, and yet can be one of the most helpful things to do to ensure more choice, power and dignity about how and where one would like to spend their final months.

Receiving a diagnosis of mesothelioma, especially if it has progressed to advanced stages and is inoperable, is extremely devastating and overwhelming, causing a cascade of complex emotions.

Coming to terms with the end of one’s life can be extremely difficult for everyone. Knowing that you have terminal cancer can shake even the strongest person. It also creates the opportunity to think about end of life issues that have never been considered before.

Knowing there is no cure and that death is inevitable, mesothelioma patients and their loved ones will need a lot of support, care and comfort. Someone who can open up conversations about the cancer, and all the feelings, fears and physical challenges that will occur provides more choice and can make the process easier to cope with. Most importantly, these conversations need to take into account and be respectful of the individual’s beliefs, needs, and desires.

Many family members, friends and even doctors and members of the medical team will not know how to begin such conversations. It may be helpful to know that research has shown that talking openly and directly about matters concerning death and dying have had hugely positive impacts for both the mesothelioma patient as well as their loved ones, before death and after.

Many fear talking about dying because of a variety of fears: fear that the patient may give up hope, that it will be interpreted as giving up, that speaking of it will make it real and final (which it already is.) In truth, having conversations about ones preferences can help patients and loved ones feel more peace and more empowered during such difficult times.

Having the courage to bring up the topic of death affects how and where patients choose to die. Many would prefer to die at home and to avoid aggressive, painful measures that may or may not prolong life. Without talking about how one wants to die, mesothelioma patients are at the mercy of the medical teams decisions and family members are not given as much of a chance to better adjust to the loss. Often times, patients will feel relief at having the reality of death acknowledged, significantly reducing anxiety and feelings of hopelessness and fear.

Most importantly, end of life conversations serve to ensure that patients and family member’s wishes and particular preferences around treatment and pain management are communicated to the medical team. In this way, patients are more likely to get the kind of care they want and feelings of pain, loss, and powerlessness can be reduced.

Everyone needs help to have such difficult conversations, but by having the courage to talk about dying, the patients’ wishes can be discovered which usually eases the process and can create stronger relationships not only between loved ones but also with the health care team and mesothelioma specialists.

Many are willing and wanting to discuss issues of death and dying. They are grateful for the opportunity to resolve family matters, discuss end of life wishes, utilize spiritual resources, and reflect on their lives and choices they have made. Often such conversations will strengthen relationships.

If you have asbestos testing done and find that there are materials in your home that were made with asbestos, you should have any asbestos removed by a professional that is trained to make sure that nobody is exposed to it. If you are exposed to it you need to see a doctor right away so that you can find out what you might be able to do in order to keep the effects to a minimum.

Stage 3 Mesothelioma Prognosis

A prognosis of stage 3 mesothelioma means that the cancer is now in its advanced stage of development. The asbestos cancer has now spread from the mesothelium, which is the point of origin, to other nearby tissues or organs. The asbestos cancer has spread to the lymph node group closest to the primary tumor location. When the lymph nodes past the chest area are affected, this causes the disease to spread at a faster pace.

Signs and symptoms of stage 3 mesothelioma include:

The spread of the mesothelioma in the body is assessed by one of the oldest cancer staging system – the Butchart System. The Butchart System is often used for staging pleural mesothelioma. It places an individual case of mesothelioma cancer in categories based on the size of the primary tumor and whether lymph nodes are affected.

A stage 3 mesothelioma prognosis is very poor. At this stage, the disease is considered too far advanced for any type of curative surgery. The survival rate at this point is extremely low. Because the cancer has now spread to other locations beyond the primary location makes it extremely difficult for any type of curative surgery. And even if the main tumor is removed, the spread of the cancer cannot be contained.

Treatments during a stage 3 mesothelioma prognosis are palliative in nature. Treatments at this stage are designed to keep the patient as comfortable as possible be relieving symptoms rather than to improve the prognosis of patients. However, if the patient is in excellent health and young, large tumors can be removed to ease discomfort in nearby organs or fluid buildup by mesothelioma paracentesis or thoracentesis. Radiation therapy and chemotherapy may also be used to relief any discomforts. Patients may also choose to participate in clinical trials which are used to test new drugs and therapies.

There are four stages of mesothelioma: Stage I, Stage II, Stage III and Stage IV. Staging is the process used to tell how far the mesothelioma has spread. Imaging studies such as x-rays, CT scans, and MRI scans are often used during the staging process. The type of treatment given and the prognosis for the patient will be determined by the stage of their cancer. The staging system often used includes the Butchart System, TNM, and Brigham Staging System.

Symptoms, Causes & Care of Pleural Mesothelioma Effusion

Effusion is the escape of fluid from a vessel into a body cavity. In some cases, mesothelioma sufferers may have certain types of effusion due to their exposure to asbestos fibers, pleural effusion being one of the more common types of effusion.

Pleural effusion happens when an increase of fluid is present between the two membranes that surround the lungs, known as the pleura. When the fluid exceeds the fluid absorption level, pleural effusions occur. The pleura provide protection for the lungs and chest cavity.

The presence of fluid is usually not detected by a routine checkup because the amount of fluids is usually very small. However, when certain disorders happen, the pleural fluid increases and may buildup causing pulmonary symptoms and signs. Once the buildup of fluid occurs, a diagnosis is required.

If pleural effusion is suspected, then confirmation needs to be established with a chest x-ray. Ultrasound is also helpful in locating small amounts or collections of isolated pockets of fluid. Chest CT is also used and is very helpful in distinguishing between parenchymal and pleural disease. Chest CT will help to show pleural thickening, pleural based mass, loculecollections of fluid, or pleural calcification.
